Your Rights: If You’ve Been in an Auto Accident

Published on Oct 6, 2009 at 11:54 am in News & Community.

No one is prepared for the devastating after-effects of being in an automobile accident. Your life is often turned upside down. At the time when you are most vulnerable, you are asked to quickly make crucial decisions without the benefit of knowledge you are entitled to. The insurance company will be calling or knocking on your door in an attempt to either get you to make a statement that may not be in your best interest and/or to get a quick settlement. Seeking immediate advice from a lawyer whose practice is concentrated in the area of injury law may be crucial to obtaining a fair and just recovery for your injuries. The insurance companies know this as well.

The goal of any injury claim is to get you back to the same state of health and economic condition you were before the accident. If this is not possible due to permanent injuries, then the goal is to achieve a settlement that takes into account permanent injuries and future expenses to cover future the medical costs, lost wages, and future pain and suffering. You are entitled to a fair compensation for the damages you incur, including the pain you endured during the time you were recovering. Certainly everyone would rather not have pain, but if you do then you have a right to have a fair value placed upon this impact on your life.

YOU HAVE RIGHTS:

  • You have the right to be compensated for related medical bills, mileage related to receiving medical treatment, pain and suffering and out of pocket expenses, including over the counter medications;
  • You have the right to fully recover or reach maximum medical improvement prior to settling your claim (subject to statute of limitations);
  • You have the right to talk to an attorney regarding your case;
  • You have the right to be kept updated on your claim;
  • You have the right to NOT give a recorded or written statement; and
  • You have the right to a copy of any written statement you give;

We are here to stand with you to help you get you the best possible results. From the beginning, we work with you to achieve immediate help with getting your car fixed and making sure that the insurance company is seeing your case in the best possible light. We want our clients focused on getting well and we will focus on making sure that the insurance company knows what you are having to go through to get back to your former self. And if that is not possible, then we make sure that the insurance company will understand you will have future pain, suffering and medical bills. Altogether it means we arrive at a just settlement that is in your best interests.

More importantly, our firm is here to walk every step of the way with you. While we make every attempt to fairly settle your claim with your permission, we also prepare to aggressively pursue your claim through the court system. Insurance companies know which law firms try cases and which choose to just settle. Although we have strive to have a good working relationship with the insurance companies, they know we champion our clients causes.

We strive for you to consider us more than just your law firm. The firm is made up of a team of dedicated professionals who walk the path with you and meet your needs. We believe you deserve our respect, our compassion and our understanding. We stand together with you and we believe we can obtain the justice that you deserve.

Local Attorney Solomon’s Trial Expertise Recognized

In recognition of his skills and experience as a practicing trial attorney, Carl L. Solomon has been invited to join the Litigation Counsel of America™ (LCA). Solomon is also Chair – Elect of The Motor Vehicle, Collision, Highway and Premises Liability Section of the American Association for Justice (AAJ) and was elected to the Board of Trustees of the National College of Advocacy.

Solomon addressed the AAJ 2009 Annual Convention held in San Francisco in July, calling upon his experience as a litigator and trial attorney to speak to audiences on “Death Star Depositions,” expert witness admissibility, and direct examination during motor vehicle, collision, highway, and premises liability cases. “The AAJ Annual Convention packs a tremendous amount of learning into a five-day program for legal professionals,” says Solomon. “I was honored to present at several sessions.”

The invitation to join the Litigation Counsel of America™ was also a welcome one, according to Solomon. “The LCA is an invitation-only honor society for litigators and trial lawyers. Less than one percent of all attorneys in the U.S. are members, so I am quite pleased to have been invited to join.” The LCA considers itself “aggressively diverse,” seeking out the most prominent litigation and trial counsel across all segments of law. Among other things, the group provides an outlet to publish legal articles written by members, promotes high ethical standards, and provides resources for professional development.

Solomon has received an AV Peer Review Rating™ from Martindale-Hubble® and is a member of the Multi-Million Dollar Advocates Forum® and partner in the Gergel, Nickles and Solomon law firm which represents clients throughout South Carolina including Columbia, Charleston, Greenville, Spartanburg, Myrtle Beach, Beaufort, and Rock Hill. Local Attorney Speaks Out to Improve Services for Victims of Crime

Published on Jul 21, 2009 at 4:22 pm in News & Community.

Columbia attorney Carl L. Solomon was among the speakers featured recently at three one-day seminars sponsored by The National Center for Victims of Crime. These seminars were offered free to professionals in South Carolina who deal with crime victims.

The training seminars, titled Civil Justice for Victims of Crime in South Carolina, were geared toward educating victim advocates, law enforcement officers, mental health service providers, social workers, prosecutors and other public officials on civil legal options available to victims.

“Some 23 million Americans become victims of crime each year,” says Carl L. Solomon. “While the criminal courts may order restitution paid to the victim, this seldom covers all the monetary costs involved and offers nothing as compensation for the victim’s pain and suffering.” A civil action filed by the victim against the perpetrator allows the victim some control and holds the defendant accountable to the victim, regardless of whether there was a successful criminal prosecution. Solomon adds, “training seminars such of those offered by The National Center for Victims of Crime provide valuable information that those working with victims can communicate.”

The July 2009 seminars were co-sponsored by the SC Victim Assistance Network, SC Coalition Against Domestic Violence and Sexual Assault, the SC Department of Juvenile Justice, and the North Myrtle Beach Department of Public Safety.

Solomon is partner in the Gergel, Nickles and Solomon law firm which represents clients throughout South Carolina including Columbia, Charleston, Greenville, Spartanburg, Myrtle Beach, Beaufort, and Rock Hill. The firm handles serious injury cases, wrongful death, product liability, and other complex cases. The firm was founded in 1983 and has five attorneys admitted to practice in South Carolina.

The National Center for Victims of Crime is dedicated to forging a national commitment to help victims of crime rebuild their lives. The National Center’s toll-free Helpline, 1-800-FYI-CALL, offers supportive counseling, practical information about crime and victimization, and referrals to local community resources, as well as skilled advocacy in the criminal justice and social service systems.
